The Panera Catering online ordering program ("Program") as applicable to bakery-cafes in the United States is available through www.paneracatering.com, and the Program as applicable to bakery-cafes in Canada is available through www.paneracatering.ca. The Program is available only at participating locations. Please see https://catering1.paneracatering.com/locations2.aspx (US) or http://paneracatering.ca/Locations (Canada) for participating locations. For locations which do not currently participate in the Program, you can still place catering orders by calling the telephone number identified for the location near you, however these Program Terms do not apply to any orders other than those placed online. Orders placed using this Site are sent to the Panera Bread bakery-cafe identified when you place your order. Each applicable bakery-cafe is individually responsible for fulfilling your order and for communicating with you regarding your order. Questions about orders placed should be directed to the bakery-cafe identified when you placed your order. Every participating bakery cafe may not have all menu items listed on menus and other information provided on this Site. Except in unusual circumstances, the bakery-cafe fulfilling your order will not substitute menu items for those you have ordered but rather will use reasonable efforts to contact you to discuss any unavailable menu items.
There may be limits on the dollar values and number of orders which may be placed on this Site. Prices for menu items ordered are identified as you place your order. There may be delivery fees, cancellation fees, taxes and other amounts due in connection with orders placed. Refunds, if any, of amounts paid for cancelled orders will be identified at the time of cancellation. Please contact the bakery-cafe responsible for fulfilling your order directly to identify these amounts due. You are responsible for payment for your online order by credit card at the time of ordering, and no orders will be processed or fulfilled unless payment by credit card has been made in advance. No payment methods other than credit card are accepted at this time.
Your username and password are for your personal use only. You are responsible for maintaining the confidentiality of your account(s), username(s) and password(s), and you are responsible for all activities that occur under your account, username and/or password. Neither Panera nor any franchisee or any supplier is responsible for undeliverable, lost, returned or misdirected emails or other correspondence related to your account, or for use of your Panera Catering account without your permission. You must be at least 18 to participate in the Program. Other discounts, coupons, offers and programs may not be combined with the Program unless specifically identified in these Program Terms or the program terms applicable to the discount, coupon, offer or program in question.
Additional details regarding the Program are identified in the FAQs section of the portion of the Site applicable to the Program. Panera reserves the right to change/modify/terminate the Program, including, without limitation, these Program Terms and the information contained within the applicable FAQs section, at any time without notice. Be sure to check these Program Terms, the Site Terms and Conditions, Privacy Policy and this Program Terms’ applicable FAQs section periodically for updates, as your continued use of the Program signifies your acceptance of any changed items. Panera may conduct test programs from time to time in certain markets which may have additional/different program terms than those described here. Please refer to the applicable test program FAQs document and/or program terms for more details. Panera has no obligation to expand or continue any test or the Program.
Information is collected about you (directly and/or through the activities of franchisees and third party suppliers and service providers (“suppliers”)) from various sources, including without limitation the following: (i) information you provide when you contact us though this Site, (ii) information you provide on the account registration pages, surveys, or other submission through this Site and/or in connection with the Panera Catering program and/or other programs available through this Site, (iii) information recorded as a result of your interaction with us and/or franchisees (including without limitation historical sales information) (through this Site or any other website or in any other manner), and (iv) information you provide when you respond to surveys conducted by or on behalf of us and/or franchisees, (v) information we collect about you from outside the scope of this Site, including without limitation information we receive from you in person, from third parties (including without limitation from franchisees and referrals from third parties).
Information provided by you on this Site is sent to suppliers of Panera and/or franchisees, and to franchisee(s) (if applicable), for purposes of processing your order, processing payment for the order, fulfilling the order, and otherwise responding to your inquiries. The information collected may be combined, used and disclosed in a number of ways by us (directly and/or through the activities of franchisees and supplier(s)), to help us better understand and serve our customers, including without limitation the following: (i) to administer the Program including fulfilling your order and responding to your inquiries, (ii) to provide you with, or otherwise respond to your requests for, information and/or services, including but not limited to e-newsletters and marketing programs, (iii) to provide you with information about new products or services, events in bakery-cafes, events that Panera or franchisee(s) sponsor, including but not limited to contests, sweepstakes and surveys, and other special offers and marketing programs, which may include information about franchisees and/or other programs any of us or them are involved with, (iv) to enhance our customers' experiences in bakery-cafes, on this Site and in the Program, (v) to analyze customer behaviors and trends, (vi) to conduct research and analysis and to otherwise measure the effectiveness of our online and offline marketing efforts and to develop products, services, and marketing programs, (vii) to coordinate Program activities and communications with other marketing programs conducted by us and/or franchisees, (viii) to enable and enhance the sales efforts of Panera and/or its franchisees, by phone, email and/or other methods, and/or (ix) as otherwise described in these Program Terms or in other sections of this Site.

Your personal information may be transferred to and within the United States and to other countries. We do not sell or rent to third parties any of the personal information that you provide to us through the Program, or authorize any of our suppliers to sell or rent any such personal information, and we do not authorize such suppliers to make independent use of your personal information for their own purposes, including but not limited to for direct marketing. However, aggregated information about customers participating in the Program, surveys or otherwise providing information to Panera (directly or through franchisees and/or supplier(s)) may be combined and utilized by Panera, franchisees and/or supplier(s) for purposes of research, benchmarking and other like uses. Additionally, your information may be disclosed in connection with a transfer/sale of business/assets, our compliance with applicable laws, and/or investigation of fraud or violation of these Program Terms and other like activities.
To remove your personal information from our catering online ordering program database please contact us by visiting the My Account page of this portion of this Site, or contact us by email at contactus@panerabread.com (please include “catering” in the subject line) or writing to us at Customer Service, Panera Bread, 3630 South Geyer Road, Suite 100, St. Louis MO 63127. This will be completed as soon as reasonably possible, unless we need to retain information for dispute resolution, troubleshooting and other valid legal or business reasons.
